Terms of Service

The agreement

These terms cover your use of Schengen Crew, operated by Cailiac FZE LLC ("we"), trade licence no. 2628913647888, CWS-1V-228062, 26th Floor, Amber Gem Tower, Ajman, United Arab Emirates. By using the service you accept them. If you are accepting on behalf of a company, you confirm you are authorised to do so.

What the service does

Schengen Crew records trips and calculates days used against the Schengen 90/180 rule. It is provided to companies: an administrator creates a fleet, adds yachts, and invites managers and crew, who use it through the website and the phone app.

This is not legal or immigration advice

The calculation is a planning aid, not an authoritative determination of your right to enter or remain in the Schengen area. Border authorities decide that, and their assessment is the one that counts. The result depends entirely on the trip dates entered being complete and correct, and the rule's application can vary with nationality, visa type, bilateral agreements and circumstances the app knows nothing about. Verify anything consequential against the European Commission's official calculator and, where it matters, take professional immigration advice. We are not liable for decisions made on the basis of the figures shown.

Your account and your data

You sign in with a Google or Microsoft account and are responsible for keeping access to it secure. You keep ownership of the data you enter. You are responsible for having a lawful basis to record the crew data you enter about other people, and for telling them you are doing so.

An administrator of a fleet can see and change the records of the crew in that fleet. If you join a fleet by accepting an invitation, you are agreeing to that.

Acceptable use

Don't use the service unlawfully, don't try to reach data belonging to fleets you are not part of, don't attempt to disrupt or reverse-engineer it, and don't upload content you have no right to upload.

Connected spreadsheets

Connecting Google Sheets or Excel on OneDrive is optional. When you connect one, you authorise us to read the file you select and to write to a worksheet we create and own by name. We do not modify the other tabs in your file. You can disconnect at any time from Settings, or revoke access from your Google or Microsoft account.

Plans and billing

A company's plan, its price and its billing period are those shown when it subscribes or set out in the quote it accepts. Payments are handled by Stripe. Prices exclude taxes, which are added where they apply.

Crew data and data protection

A company that records its crew in Schengen Crew decides what is recorded and why, and we process that data on its behalf, as described in our Privacy Policy. A data processing agreement is available on request.

Ownership

The service, the app and their design belong to us. Your data stays yours, and you can download your crew list at any time. If you send us ideas for the product, we may use them without obligation to you.

Availability

We aim to keep the service running but do not guarantee uninterrupted availability. The service is provided "as is", without warranties of any kind, to the fullest extent permitted by law. Keep your own records of anything you cannot afford to lose.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profit, revenue or data. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim. Nothing here excludes liability that cannot lawfully be excluded.

Ending it

You can stop using the service and ask us to delete your data at any time. We may suspend or end access where these terms are breached, or where required by law.
